# TERMS AND CONDITIONS **Last updated: 6 October 2026** These Terms and Conditions govern access to and use of **madeinmaia.pt**, the Made in Maia online store, and any related features, pages, services or projects operated through the website, including **LinkLabel**. By accessing the website, using LinkLabel, placing an order or otherwise using our services, you agree to these Terms and Conditions. If you do not agree with these Terms, please do not use the website or services. --- ## 1. ABOUT US The website is operated by: **Trading name:** Made in Maia **Legal entity / proprietor:** [LEGAL NAME] **Tax/VAT number (NIF/NIPC):** [NUMBER] **Registered/business address:** [ADDRESS], Portugal **Email:** [EMAIL ADDRESS] References in these Terms to **“Made in Maia”**, **“we”**, **“us”** or **“our”** mean the business identified above. --- # PART I — GENERAL WEBSITE TERMS ## 2. USE OF THE WEBSITE You may use this website only for lawful purposes. You must not: - interfere with the operation or security of the website; - attempt to gain unauthorised access to systems, accounts or data; - introduce malware, malicious code or other harmful material; - scrape, reproduce or systematically extract website content without permission; - use the website for unlawful, fraudulent, abusive or misleading purposes; - use our services in a way that infringes the rights of another person. We may suspend, restrict or terminate access to any part of the website where reasonably necessary for security, maintenance, abuse prevention, legal compliance or protection of our rights. --- ## 3. WEBSITE AVAILABILITY We aim to keep the website available and functioning correctly, but continuous or uninterrupted access is not guaranteed. The website, LinkLabel, individual links, pages, products or features may temporarily or permanently become unavailable. We may modify, suspend, replace or discontinue parts of the website or services without prior notice where reasonably necessary. To the maximum extent permitted by law, Made in Maia shall not be responsible for losses caused solely by temporary website outages, hosting failures, internet failures, maintenance, technical errors or circumstances outside our reasonable control. Nothing in this section excludes liability that cannot legally be excluded. --- # PART II — ONLINE STORE ## 4. PRODUCTS We make reasonable efforts to describe and display products accurately. However, colours may appear differently depending on the device, display settings, lighting and manufacturing or printing process. For handmade, individually printed, small-batch or customised products, minor differences in placement, colour, dimensions or finish may occur and do not necessarily constitute defects. Product images are illustrative unless expressly stated otherwise. --- ## 5. DTF PRINTING AND GARMENT VARIATIONS Some Made in Maia garments use DTF or other garment-printing methods. Minor variations between individual printed items may occur due to the nature of the production process. Printed garments must be washed and cared for according to the supplied care instructions. Normal deterioration resulting from wear, misuse, inappropriate washing, tumble drying, ironing directly over a print, bleaching or other failure to follow care instructions is not considered a manufacturing defect. This does not affect statutory rights relating to defective or non-conforming goods. --- ## 6. PRICES Prices shown on the website are displayed in euros unless otherwise stated. Applicable VAT will be included where legally required. Delivery charges, if applicable, are shown separately before the customer completes the purchase. We may change prices at any time, but price changes will not affect an order already accepted by us. Obvious pricing, typographical or technical errors do not bind us. If an obvious error affects an order, we may contact you before fulfilment and offer the choice of proceeding at the correct price or cancelling the order for a full refund. --- ## 7. ORDERS Submitting an order constitutes an offer to purchase the selected goods. An order is accepted when we confirm acceptance or dispatch the goods, depending on the checkout process in use. We reserve the right to refuse or cancel an order where reasonably justified, including where: - a product is unavailable; - payment cannot be authorised; - information supplied by the customer appears incorrect or fraudulent; - an obvious pricing or product-description error has occurred; - the order would breach applicable law; - fulfilment is impossible. If payment has already been received for an order that we cannot fulfil, the applicable amount will be refunded. --- ## 8. PAYMENT Payment must be made using one of the payment methods displayed at checkout. Payment processing may be performed by third-party payment providers. Made in Maia does not control independent payment providers and is not responsible for failures occurring exclusively within their systems, except where applicable law provides otherwise. You are responsible for supplying complete and accurate billing and payment information. --- ## 9. DELIVERY Available delivery destinations, shipping methods, restrictions and costs are displayed during the ordering process where applicable. Any stated delivery date is an estimate unless we expressly agree that a specific date is guaranteed. We are not responsible for delays directly attributable to incorrect delivery details supplied by the customer or events outside our reasonable control. Nothing in these Terms limits any mandatory delivery rights available under Portuguese or EU consumer law. --- # PART III — RETURNS, WITHDRAWAL AND GUARANTEES ## 10. 14-DAY RIGHT OF WITHDRAWAL Where Portuguese and EU consumer law applies, consumers purchasing remotely generally have the right to withdraw from an eligible contract within **14 calendar days** without giving a reason. For goods, this period generally runs from the day on which the consumer, or a third party designated by the consumer other than the carrier, acquires physical possession of the goods. To exercise the right of withdrawal, you must clearly inform us of your decision within the applicable period. Further return instructions may be provided in our Returns Policy. --- ## 11. PERSONALISED AND CUSTOM-MADE PRODUCTS The statutory right of withdrawal may not apply to goods made according to the consumer's specifications or goods that are clearly personalised, to the extent permitted by applicable law. This may include, depending on the individual order: - custom wording; - customer-selected artwork produced specifically for that customer; - individually personalised prints; - bespoke garments; - products manufactured specifically according to the customer's instructions. This exception does **not** remove a customer's legal rights where a personalised product is defective, damaged, incorrectly produced or otherwise not in conformity with the contract. --- ## 12. CONDITION OF RETURNED GOODS Where a statutory withdrawal right applies, customers may inspect goods to the extent reasonably necessary to establish their nature, characteristics and functioning. The customer may be responsible for any reduction in value resulting from handling beyond what is reasonably necessary for that purpose, where permitted by law. Return shipping costs are borne by [CUSTOMER / MADE IN MAIA — SELECT POLICY], except where the goods are defective, incorrectly supplied or applicable law requires otherwise. --- ## 13. REFUNDS Where a valid statutory withdrawal is exercised, refunds will be processed in accordance with applicable consumer law. Unless otherwise agreed, refunds are normally made through the original payment method. We may withhold reimbursement where legally permitted until the returned goods are received or the consumer supplies evidence that the goods have been returned. --- ## 14. STATUTORY GUARANTEE Nothing in these Terms removes or reduces the customer's statutory rights regarding goods that fail to conform to the sales contract. For consumers, the mandatory legal guarantee and conformity rights established under Portuguese law apply. Any commercial guarantee voluntarily offered by Made in Maia is additional to, and does not replace, statutory consumer rights. --- # PART IV — CUSTOMER-SUPPLIED DESIGNS ## 15. CUSTOMER CONTENT Where customers submit text, photographs, graphics, logos, illustrations or other material for printing or customisation, the customer confirms that they have the necessary rights and permissions to use that material. The customer is responsible for customer-supplied content. You must not ask us to reproduce material that: - unlawfully infringes copyright, trademark or other intellectual property rights; - violates privacy or personality rights; - is unlawful; - constitutes illegal hate content; - contains illegal sexual material; - promotes criminal activity; - otherwise cannot lawfully be produced or distributed. We may refuse a custom printing request where we reasonably believe that producing it could be illegal or expose Made in Maia to legal liability. --- ## 16. CUSTOMER RESPONSIBILITY FOR SUPPLIED MATERIAL To the maximum extent permitted by law, the customer is responsible for claims arising directly from materials supplied by that customer where the customer did not have the necessary rights or authorisations to use them. Nothing in this section imposes liability on the customer where liability cannot legally be imposed. --- # PART V — LINKLABEL ## 17. WHAT LINKLABEL IS **LinkLabel** is a discovery and redirection feature operated or presented by Made in Maia. It may provide access to, redirect users toward or display references to content available elsewhere on the internet. LinkLabel is primarily a **discovery tool**. Unless expressly stated otherwise, third-party material reached through LinkLabel is **not created, hosted, owned, operated, endorsed or controlled by Made in Maia**. --- ## 18. RANDOM AND EXTERNAL CONTENT Some LinkLabel destinations may be selected randomly, semi-randomly or from a curated database. By using LinkLabel, you understand that you may be redirected away from madeinmaia.pt to an independent third-party website or service. The internet changes constantly. A destination that was harmless, functioning or appropriate when added to the LinkLabel database may later: - change ownership; - change its content; - become unavailable; - redirect somewhere else; - introduce advertising; - introduce tracking; - become compromised; - alter its age suitability; - contain material that was not previously present. Made in Maia cannot continuously control every external destination. --- ## 19. NO ENDORSEMENT OF EXTERNAL CONTENT A link appearing through LinkLabel does not imply endorsement, approval, sponsorship, partnership or affiliation. The inclusion of a third-party link means only that the link has been selected for discovery, historical, cultural, entertainment or informational purposes. Opinions expressed on third-party websites belong to their respective authors or operators. --- ## 20. THIRD-PARTY WEBSITE DISCLAIMER Once you leave madeinmaia.pt, the destination website is controlled by its own operator. Users should exercise normal internet caution when following external links. --- ## 21. CONTENT MAY BE STRANGE, OUTDATED OR UNEXPECTED LinkLabel deliberately explores internet culture. Some material may be unusual, absurd, outdated, satirical, confusing, provocative or culturally specific. Material may reflect the time in which it was created and may contain language, attitudes or references that would not necessarily be used by Made in Maia. Displaying or linking to historical or cultural material does not mean Made in Maia adopts the opinions or messages contained in it. --- ## 22. LINKLABEL CONTENT MODERATION We may add, remove or replace links at any time. If we become aware that a destination contains unlawful material, malware, deceptive redirects or other seriously harmful content, we may remove it. Users may report a problematic LinkLabel destination to: **[EMAIL ADDRESS]** Please include the URL or enough information for us to identify the link. --- ## 23. LINKLABEL AVAILABILITY No particular LinkLabel destination is guaranteed to remain available. Links may break or disappear because external websites change or cease operating. We do not guarantee: - that every destination will work; - that archived material remains available; - that an external site's content will remain unchanged; - that a particular LinkLabel result will be available indefinitely; - that external material is accurate or complete. --- ## 24. USER CHOICE Following a LinkLabel link is voluntary. Users are responsible for deciding whether to visit, continue using, register with, download from, purchase from or interact with any external website. Where a third-party website requests personal information, payment information, account creation, software installation or downloads, users should independently assess whether they trust that provider. --- # PART VI — INTELLECTUAL PROPERTY ## 25. MADE IN MAIA CONTENT Unless otherwise stated, Made in Maia owns or is authorised to use the content created specifically for madeinmaia.pt, including applicable: - logos; - branding; - original artwork; - website design; - photography; - product descriptions; - graphics; - text; - software and databases. References or links to third-party works through LinkLabel do not imply ownership by Made in Maia. If you are a rights holder and believe that material directly hosted or displayed by Made in Maia infringes your rights, contact us at **[EMAIL ADDRESS]** with sufficient information to identify the material and your claim. We will review legitimate notices. --- # PART VII — DISCLAIMERS AND LIABILITY ## 27. INFORMATION PROVIDED “AS IS” General editorial, cultural, historical, entertainment and LinkLabel content is provided on an **“as is”** and **“as available”** basis. We make reasonable efforts to operate the website responsibly, but we do not guarantee that non-contractual informational content will always be complete, current, error-free or suitable for a particular purpose. --- ## 28. LIMITATION OF LIABILITY To the **maximum extent permitted by applicable law**, Made in Maia shall not be liable for indirect, incidental, consequential or purely economic losses arising from use of free website features or LinkLabel, where such liability may legally be excluded. In particular, and subject always to mandatory law, we are not responsible for damage resulting solely from: - the independent actions of third-party websites; - a third party changing linked content; - reliance on non-professional entertainment or informational content; - external services becoming unavailable; - voluntary downloads or software installed from external websites; - independent purchases or agreements entered into with third parties; - user misuse of the website; - circumstances outside our reasonable control. --- ## 29. LIABILITY THAT IS NOT EXCLUDED Nothing in these Terms excludes, limits or attempts to waive liability where exclusion or limitation is prohibited by law. In particular, these Terms do not remove rights arising from: - defective or non-conforming products; - fraud or fraudulent misrepresentation; - wilful misconduct where liability cannot legally be excluded; - death or personal injury where liability cannot legally be excluded; - any other liability which Portuguese or EU law makes mandatory. If any exclusion or limitation in these Terms exceeds what is permitted by law, it shall apply only to the maximum extent legally permitted. --- ## 30. Nothing in these Terms requires a consumer to waive a court or jurisdiction right that cannot legally be waived. --- ## 40. The remaining provisions shall continue in effect. --- ## 41.
